Energy Performance Contract Document Creation
E/S3 has enjoyed a long relationship with people in the University’s Physical Plant Department and when an energy saving performance contract project was being considered, the University, through Lobo Energy Incorporated, its research park corporation, hired us to develop contract documents for the project that could be used as models for the future.
The State of New Mexico had recently moved forward with a statewide energy saving performance contract program adopting many elements of the processes and contract documents created by E/S3 for the Wyoming Energy Conservation Improvement Program (WYECIP) as models. E/S3 understands the intent of the contract language as the original author, so these documents were used as a starting point and expanded to creating a customized owner-centric contract package that protected the University’s interests.
Services provided by E/S3 included the following:
- Reviewing existing UNM guidelines, requirements and construction contracts.
- Editing existing language or inserting additional language to incorporate UNM-specific requirements.
- Including UNM guidelines for construction projects and standard terms and conditions.
- Utilizing E/S3’s previous practical ESPC implementation experience to include language to help ensure commonly experienced problems are addressed.
- Developing standard contract schedule formats where practical following the list defined in the State model contract.
- Developing optional schedules and other attachments as required by Lobo/UNM.
- Creating cost accounting and “open book pricing” documentation requirements to be included in contracts.
- Incorporating UNM commissioning guidelines and scope.
- Preparing Measurement & Verification guidelines and requirements for reporting to be included in contracts.
- Conducting draft review meeting(s) with Lobo/UNM legal counsel.
- Updating draft documents based upon review comments.
- Finalizing documents and providing templates to Lobo/UNM.
